GTNet Additional Terms

These Additional Terms of Use (“Additional Terms”) govern Your use of GTNet and its cloud service(s) (collectively, “GTNet”) as an individual user or authorized representative of an entity (“You/Your”), and are incorporated by reference into the GT Booster General Terms of Use (“General Terms”) (these Additional Terms and the General Terms are referred to collectively as the “Terms”). Capitalized terms not defined here have the same meaning as those terms defined in the General Terms. These Additional Terms will govern where it conflicts with the General Terms. By accessing and using GTNet, you accept and agree to the Terms.

1. Agreement to the Additional Terms

1.1 Acceptance of the Additional Terms. By accessing or using GTNet, You accept and agree to all of the Terms. If You do not accept or agree to all of the Terms, do not use GTNet in any manner. You can find a copy of the General Terms of use here. Please also carefully read our Privacy Policy. By agreeing to the Terms, You also accept and agree to our Privacy Policy.

1.2 Acceptance of the Terms on Behalf of an Entity. If You are acquiring GTNet on behalf of an entity, You must be properly authorized to represent that entity and accept the Terms on its behalf.

2. Use of GTNet

Use by Third Party. You may permit authorized third parties to exercise the usage rights on Your behalf and solely at Your own risk and responsibility, provided that (i) You are responsible for ensuring that such authorized third parties comply with the Terms, and (ii) You are responsible for any breach of these Terms by such authorized third parties.

3. Ownership

Except where expressly agreed in writing, nothing in these Terms transfers ownership in, or grants any license to any intellectual property rights. GT Booster retains all ownership of the GT Booster Services, Software and Content.

4. Additional License Restrictions

4.1 Non-Exclusive, Limited License. GTNet is made available to You on the basis of a non-exclusive, limited license only as set out in these Terms. You may not rent, lend, lease, or sell all or portions of GTNet. You may not copy and distribute GTNet to others for a fee or provided at no cost. Any type of copying of the registered version GTNet to another device is prohibited by copyright law or international treaties. Any attempts to defeat the copy protection features incorporated into GTNet is a violation of these Terms and applicable laws.

4.2 Intellectual Property. GT Booster and its third-party service providers own their respective title, copyright, trade secret, patent rights and other intellectual property rights in GTNet and any relevant documentation, and reserve all respective rights not expressly granted to You in these Terms. You will not acquire such rights, whether through estoppel, implication, or otherwise.

5. Consent to Use of Data

5.1 GTNet Activation and Services. When using GTNet, GTNet will validate Your account with GT Booster servers. This control helps ensure that validly licensed accounts can access GT Booster's cloud services.

5.2 Data We May Collect Through Your Use of GTNet. The data that we may collect about You and Your device through Your use of GTNet includes the following:
  • Connection Data. We collect information such as the destination domain name or destination IP address in order to query our database for the application category. GT Booster does not process this type of data in a manner that identifies You or Your device.

At all times, Your personal data collected by GT Booster through Your use of GTNet will be treated in accordance with our Privacy Policy.

5.3 Supplement to Our Privacy Policy. This Section 5 describes the data we may collect through Your use of GTNet and supplements our Privacy Policy. For personal data we may collect from You through Your interaction with us, the choice You make (such as Cookie Settings), or Your prior consent, please refer to Section 1 of our Privacy Policy.

6. Refund and Cancellation

6.1 Cancellation. You may request to cancel the GTNet subscription at any time and will continue to have access to the service until the end of the billing period. As GTNet is a recurring billing subscription service, it is recommended that cancellation requests be made prior to the payment deadline for the next billing cycle.

6.2 Cancellation After Billing Cycle. In the event that You request cancellation of the subscription after payment for the next billing period, You will be charged for the aforementioned period and can continue to use the service for the remainder of the billing period.

6.3 Refund Policy. To the extent permitted by applicable law, payments are non-refundable and GTNet does not offer refunds or credits for partially used subscription cycles or unused content. The right to a refund will only arise in the event of a breach of any obligation on the part of GT Booster, and will only be allowed in the event that there is no violation of any rule herein. Refunds will not be allowed for reasons related to inoperability, failure, or unavailability of service as a result of You or any other third party's connection.

7. Indemnification

In addition to Section 11 (Indemnification) in the General Terms, GT Booster has no obligation with respect to any claim based on:
  • Your modification of GTNet or modification by a third party;
  • The amount or duration of use made of GTNet, revenue You earned, or services You offered;
  • Combination, operation, or use of GTNet with non-GT Booster products, software or business processes;
  • Your failure to modify, update, or replace GTNet as required by GT Booster;
  • Any additional functionality offered through GTNet at a no charge, beta or evaluation basis.
